These Terms and Conditions include our Refund and Cancellation Policy.

1. About These Terms

These Terms and Conditions ("Terms") govern purchases from and use of Academy of Skills, including our website, learner platform, online courses, subscriptions, assessments, certificates, transcripts and related services.

Please read these Terms carefully before purchasing or using our services.

When you purchase directly from Academy of Skills, you enter into a contract with us subject to these Terms and any specific information or conditions shown to you before you complete your purchase.

Academy of Skills courses may also be sold through third-party websites, marketplaces, partners or other authorised platforms. Special provisions applying to those purchases are explained in these Terms.

Nothing in these Terms excludes, restricts or otherwise affects any statutory rights you have as a consumer which cannot lawfully be excluded or restricted.

  • "you", "your", "learner", "student" and "customer" refer to the person purchasing or using our services;
  • "course" means an online course provided by or on behalf of Academy of Skills;
  • "subscription" means an arrangement giving access to eligible courses or services for a specified period; and
  • "third-party platform" includes a third-party website, marketplace, reseller, partner or other authorised platform through which an Academy of Skills course may be offered or purchased.

3. Our Services

Academy of Skills provides online courses and related educational services.

Depending on the product or service purchased, these may include:

  • access to online course content;
  • learning materials;
  • online assessments or quizzes;
  • learner progress tracking;
  • individual course access;
  • subscription access to eligible courses;
  • digital certificates or transcripts where included or purchased; and
  • hard-copy certificates or transcripts where separately available.

The exact features, content, access period, certificate entitlement, subscription benefits and price applicable to a purchase will be displayed on the relevant course page, subscription page or at checkout.

Not every course or purchase necessarily includes every feature listed above.

4. Course Development and Quality

Academy of Skills is committed to providing learners with high-quality and accessible online learning.

Our courses are created and/or developed with experienced instructors, subject-matter contributors and our in-house course development team, with the aim of providing useful, relevant and high-quality learning experiences for our students.

Courses may go through research, development, review and quality-control processes appropriate to the subject and type of course.

We may review, improve and update course materials from time to time to:

  • maintain or improve quality;
  • improve the learning experience;
  • correct errors;
  • clarify course material;
  • update information;
  • reflect developments in a subject; or
  • improve accessibility or usability.

The nature of education means that individual learning experiences and levels of understanding may vary. We cannot guarantee that every learner will understand every subject immediately or that completion of a course will produce a particular academic, professional, employment or commercial outcome.

Nothing in this section reduces our responsibility to provide digital content and services in accordance with applicable UK consumer law.

5. Questions About Course Content and Learner Support

We encourage students to contact us if they have difficulty understanding part of a course or have questions about the course material.

You may contact us if you:

  • do not understand part of a course;
  • have a question about the course material;
  • believe a topic requires further explanation;
  • believe information in a course requires clarification; or
  • require reasonable assistance relating to the educational content of a course.

To help us investigate your question efficiently, please provide your name, the email address associated with your learner account, the course name and sufficient details identifying the lesson, module or subject concerned.

Our support team may need to refer your question to the relevant course-material expert, instructor, subject-matter contributor or course development team.

Please allow us a reasonable amount of time to investigate the question, consult the appropriate course-material expert where necessary and respond to you.

Response times may vary depending on the nature and complexity of the question and the availability of the appropriate subject-matter expert.

6. Course Information

We aim to describe our courses accurately and provide relevant information before purchase.

Before purchasing, you should review the applicable:

  • course description;
  • curriculum or syllabus;
  • course access period;
  • price;
  • assessment requirements;
  • certificate information;
  • accreditation or endorsement information, where applicable; and
  • other material conditions displayed on the relevant course page.

Course descriptions provide an overview of the content and are not intended to reproduce every individual element of a course.

We may make reasonable updates to course content after purchase where necessary to improve or maintain its quality, accuracy, relevance or usability.

We will not use this right to make arbitrary material changes that unfairly deprive you of the essential benefit of a course you have purchased.

7. Educational Nature of Our Courses

Unless expressly stated otherwise on the relevant course page, Academy of Skills courses are online educational and professional-development courses.

Purchasing or completing a course does not by itself guarantee:

  • employment;
  • promotion;
  • increased income;
  • entry into a particular occupation;
  • admission to another educational institution;
  • membership of a professional organisation;
  • a professional licence;
  • a regulated qualification;
  • immigration or visa eligibility; or
  • any particular academic, professional or career outcome.

You are responsible for checking any specific employer, professional, educational, regulatory or licensing requirements relevant to the purpose for which you intend to use a course.

Nothing in this section allows us to misrepresent the nature, accreditation, endorsement or recognition of a course.

8. Accreditation, Endorsement and Recognition

Where an Academy of Skills course is accredited, endorsed, recognised or associated with a third-party organisation, the relevant course page should explain the nature of that arrangement.

Not every Academy of Skills course is necessarily accredited or endorsed by an external organisation.

An Academy of Skills certificate of completion does not automatically constitute a regulated qualification or professional licence.

If accreditation, endorsement, professional recognition or a particular type of certificate is important to your decision to purchase a course, you should check the applicable course information before purchasing.

For courses purchased through third-party platforms, accreditation, endorsement, certification and related benefits may differ from the equivalent course purchased directly from Academy of Skills.

You should therefore review the particular course listing on the third-party platform before making your purchase.

9. Creating and Using Your Learner Account

You may need an Academy of Skills learner account to purchase, access or complete a course.

You agree to provide accurate information when creating and maintaining your account.

You are responsible for:

  • keeping your login credentials secure;
  • maintaining control of your account;
  • not sharing your password with another person;
  • notifying us if you reasonably believe your account has been compromised; and
  • keeping relevant account information reasonably accurate.

Unless we expressly agree otherwise, learner accounts and course access are for individual use.

You must not sell, transfer, lend or share your learner account or course access with another person.

10. Placing an Order Directly With Academy of Skills

When you place an order through academyofskills.org, you are offering to purchase the relevant course, subscription, certificate, transcript or other service subject to these Terms.

Before submitting your order, you should be given an opportunity to review relevant information and correct applicable errors.

A contract between you and Academy of Skills is formed when we accept your order and provide confirmation, normally by email and/or by making the purchased service available through your learner account.

You should retain your order confirmation and these Terms for your records.

We may refuse or cancel an order before acceptance where reasonably necessary, including where:

  • a product has been listed in error;
  • there is an obvious pricing error;
  • payment cannot be authorised;
  • we reasonably suspect fraud or misuse; or
  • we cannot provide the purchased service.

If we cancel an accepted order after receiving payment and you are entitled to repayment, we will refund the relevant amount.

11. Prices, Discounts and Promotions

The price payable is the price presented to you before you complete your purchase, subject to correction of obvious errors where permitted by law.

We may change prices for future purchases at any time.

Changing an advertised price does not retrospectively change the price of an order we have already accepted.

We may offer:

  • promotional prices;
  • discount codes;
  • voucher codes;
  • limited-time offers;
  • introductory subscription prices; or
  • other promotions.

Promotions may have eligibility criteria, expiry dates, product restrictions, usage limits or other conditions that will be stated with the relevant offer where applicable.

Unless expressly stated otherwise, promotional codes cannot be combined.

Purchasing a course at a discounted or promotional price does not by itself remove or reduce your statutory consumer rights.

Optional extras will not be charged solely because of a pre-selected option where applicable law requires your express consent.

12. Payments

Payments made directly through Academy of Skills are processed through Stripe or another payment method identified at checkout.

Academy of Skills does not store your full payment card details in its own systems.

By submitting a payment, you confirm that you are authorised to use the payment method provided.

We may receive limited transaction information from our payment processor that allows us to confirm, administer, investigate or refund a payment.

If payment is declined, reversed, charged back or otherwise unsuccessful, we may delay or suspend access to the relevant paid service while the matter is reasonably investigated or until valid payment has been received.

Different payment arrangements may apply to purchases made through third-party platforms.

13. Individual Course Access

An individual course purchase provides you with a personal, limited, non-exclusive and non-transferable right to access and use the relevant course for your own learning during the applicable access period.

Unless otherwise expressly stated on the relevant course page or at checkout, individual Academy of Skills courses are normally provided with 365 days of access from the applicable purchase or activation date.

If a different access period is clearly stated before purchase, that stated period will apply.

Purchasing course access does not transfer ownership of the course or its intellectual property to you.

14. Subscriptions

Academy of Skills may offer subscriptions providing access to eligible courses or other specified benefits during the subscription period.

We may offer both:

  • fixed-term subscriptions that do not automatically renew; and
  • subscriptions that automatically renew until cancelled.

Before purchasing a subscription, you should be provided with important information applicable to that subscription, including as relevant:

  • price;
  • billing frequency;
  • subscription duration;
  • whether it automatically renews;
  • courses or benefits included;
  • any material exclusions;
  • how to cancel; and
  • other important conditions.

Not every Academy of Skills course or product is necessarily included in every subscription.

The particular subscription description applicable when you purchase determines what is included.

15. Fixed-Term Subscriptions

Where a subscription is expressly identified as fixed-term and non-renewing, access will normally end automatically when the stated subscription period ends.

You will not automatically be charged for another fixed term unless you have separately agreed to an arrangement permitting renewal.

You may purchase another subscription after the fixed term ends where available.

16. Automatically Renewing Subscriptions

Where a subscription is clearly identified before purchase as automatically renewing, it will renew according to the billing frequency and price disclosed to you unless cancelled.

By purchasing an automatically renewing subscription, you authorise our payment processor to collect the applicable recurring subscription charge using your selected payment method until the subscription is cancelled or otherwise ends.

You may cancel an automatically renewing subscription using the cancellation method made available to you.

Cancellation stops future renewal charges in accordance with the applicable arrangements.

Unless otherwise stated or required by law, cancellation does not normally terminate access for a subscription period that has already been paid for. You may normally continue using the subscription until the end of that paid period.

We will not deliberately impose unreasonable obstacles to cancellation.

Where applicable UK law provides additional requirements concerning renewal reminders, cooling-off rights, cancellation mechanisms or subscription information, those requirements will apply when legally in force and applicable to your contract.

17. Subscription Price Changes

We may change subscription prices from time to time.

A price change will not retrospectively increase an amount already paid.

Where an automatically renewing subscription will renew at a higher price, we will provide appropriate information or notice where required by applicable law.

If you do not wish to continue at the changed price, you may cancel before the relevant renewal in accordance with the applicable cancellation arrangements.

18. Course Access and Website Availability

We aim to make purchased courses available during their applicable access periods.

However, uninterrupted access cannot be guaranteed.

Temporary disruption may occur because of:

  • planned maintenance;
  • emergency maintenance;
  • security requirements;
  • software or platform updates;
  • internet or infrastructure failures;
  • hosting or technology-provider problems;
  • cyber incidents; or
  • circumstances outside our reasonable control.

We will take reasonable steps to minimise material disruption.

If a significant issue within our reasonable control materially prevents you from accessing a purchased service for an unreasonable period, please contact us so that we can investigate and provide an appropriate remedy where required.

19. Assessments

Some courses may contain quizzes, tests or assessments.

Assessment requirements and applicable pass marks, where relevant, will be explained within the course or assessment information.

Assessments must be completed honestly and personally unless collaborative work is expressly permitted.

You must not:

  • have another person complete an assessment for you;
  • complete an assessment under another person's identity;
  • manipulate assessment systems;
  • fraudulently obtain results; or
  • otherwise compromise the integrity of an assessment.

Where reasonably necessary to protect the integrity of our courses and certificates, we may investigate suspected misuse.

We may withhold, revoke or correct a result or certificate obtained through fraud, impersonation or other serious misuse, subject to applicable law.

20. Certificates and Transcripts

Certificates or transcripts may be available following successful completion of eligible courses.

Whether a digital certificate, transcript or other certification product:

  • is included in the course price;
  • is available free of additional charge; or
  • requires a separate payment

will be indicated on the relevant course page, learner area or checkout where applicable.

You are responsible for ensuring that your name and other relevant information are accurate before requesting or generating a certificate.

Academy of Skills certificates evidence completion of the applicable Academy of Skills course. They do not constitute regulated qualifications or professional licences unless this is expressly stated.

21. Hard-Copy Certificates and Transcripts

Where available, you may order a physical certificate or transcript for delivery to the postal address you provide.

You are responsible for providing a complete and accurate delivery address.

Additional charges may apply for:

  • hard-copy certificates;
  • transcripts;
  • postage;
  • international delivery;
  • replacement documents; or
  • other optional certification services.

Applicable mandatory charges will be shown before you complete the relevant purchase.

Delivery times may vary according to destination and the relevant postal or courier service.

If a physical document arrives damaged, contains a material error caused by us or does not arrive within a reasonable period, please contact us.

22. Purchases Through Third-Party Websites and Marketplaces

Academy of Skills courses may be offered or sold through third-party websites, marketplaces, partners, resellers or other authorised platforms.

If you purchase an Academy of Skills course through a third-party platform rather than directly through academyofskills.org, the third party may be responsible for some or all aspects of your transaction.

Your purchase may be subject to the third party's own:

  • Terms and Conditions;
  • payment terms;
  • refund and cancellation policy;
  • privacy policy;
  • course-access arrangements;
  • certificate or transcript arrangements; and
  • other applicable rules or policies.

You should review the applicable third-party information before making your purchase.

Where a problem relates specifically to an order, payment, cancellation or refund administered by the third-party platform, you should normally contact that platform in the first instance.

Nothing in this section removes statutory rights you may have against Academy of Skills or the relevant third party under applicable law.

23. Third-Party Marketplace Payments

Where an Academy of Skills course is purchased through a third-party platform, payment may be collected and processed entirely by that third party.

In those circumstances, Academy of Skills may not receive or have access to your payment-card details.

The third party's payment terms and privacy practices will apply to its processing of your payment information.

Where the third party controls the transaction, we may not have the technical or contractual ability to directly refund a payment collected by that platform.

24. Third-Party Certificates, Transcripts and Accreditation

Where you purchase an Academy of Skills course through a third-party platform, the certificate, transcript, completion documentation or accreditation-related service associated with the purchase may in some cases be provided or administered by that third party rather than directly by Academy of Skills.

The arrangements may therefore differ from those available when purchasing directly from academyofskills.org.

Depending on the arrangement, a third-party platform may be responsible for:

  • issuing or providing course certificates;
  • providing transcripts;
  • certificates of completion;
  • hard-copy certificates or transcripts;
  • certificate fees;
  • replacement certificates;
  • certificate corrections;
  • certificate verification;
  • delivery of certificates or transcripts; or
  • accreditation or certification-related administration.

Where the third-party platform is responsible for one of these services, you should contact that platform directly and follow its applicable procedures, policies and Terms and Conditions.

Academy of Skills may not be able to issue, amend, replace, verify or administer documentation for which the third-party platform is responsible.

Information concerning accreditation, endorsement or certification for a marketplace purchase should be checked against the particular course listing through which you purchased the course.

If the third-party platform is responsible for accreditation-related information or documentation connected with your purchase, please contact that platform in the first instance.

If you are unsure who is responsible, you may contact us at info@academyofskills.org, and we will provide reasonable assistance where we are able to identify the relevant arrangement.

25. Personal Information and Third-Party Platforms

When you purchase an Academy of Skills course through a third-party platform, that platform may collect and process your personal information in accordance with its own privacy policy and applicable data protection obligations.

Depending on the platform, its policies, its technical arrangements and its relationship with Academy of Skills, it may or may not share information about you with us.

Where information is shared with us, it may include information reasonably required to:

  • identify your enrolment;
  • provide course access;
  • administer the learner relationship;
  • provide learner support;
  • maintain course or completion records; or
  • administer certificates or transcripts where we are responsible for doing so.

Academy of Skills does not control how an independent third-party platform collects or uses personal information before that information is provided to us.

You should therefore review the third party's Privacy Policy before providing personal information through that platform.

Where personal information is provided to Academy of Skills, we will process the information we receive in accordance with our Privacy Policy and applicable data protection law.

26. Our 14-Day Refund and Cancellation Policy

Academy of Skills wants learners to purchase courses with confidence.

Our refund arrangements operate alongside your statutory consumer rights.

Nothing in this Refund and Cancellation Policy removes or restricts rights or remedies that cannot legally be excluded.

26.1 Direct Academy of Skills Purchases

Subject to the conditions below, Academy of Skills provides a 14-day refund period for eligible course purchases made directly through Academy of Skills.

A request under our voluntary refund policy must normally be made within 14 days of the relevant purchase.

26.2 Completed Courses

Our voluntary 14-day refund guarantee is not available where the student has fully completed the relevant course before requesting a refund.

The purpose of this condition is to prevent the entire educational product being consumed before a change-of-mind refund is requested.

This restriction does not remove any statutory rights or remedies you may have if the digital content is faulty, not as described or otherwise fails to conform to applicable consumer law.

26.3 After 14 Days

Our voluntary 14-day change-of-mind refund period normally ends after 14 days.

Refund requests submitted after that period will not normally qualify under our voluntary refund guarantee.

This does not affect any statutory right or remedy that continues to apply.

27. Statutory Cancellation Rights for Digital Content

UK consumer law contains specific rules concerning cancellation rights for digital content supplied during the statutory cancellation period.

Where you request or agree that digital course content should be supplied immediately, before the applicable statutory cancellation period has ended, we may ask you at checkout to:

  1. expressly consent to supply of the digital content beginning immediately; and
  2. acknowledge the applicable consequence for your statutory cancellation right once supply begins.

Where the legal requirements for loss of the statutory cancellation right are satisfied, the statutory right to cancel the digital-content contract may end when supply begins.

Where those requirements have not been satisfied, we will not treat your statutory cancellation right as lost merely because you accessed digital content.

Our voluntary 14-day refund guarantee is separate from statutory cancellation rights and may provide additional protection, subject to its stated conditions.

28. Faulty or Misdescribed Courses and Digital Content

Your statutory rights are separate from our voluntary 14-day refund guarantee.

Digital content provided to consumers must meet applicable requirements under UK consumer law.

If purchased digital content is faulty, materially different from its description or otherwise fails to conform to the contract, you may have statutory remedies.

Depending on the circumstances and applicable law, these may include repair or replacement and, where the relevant legal conditions are satisfied, a price reduction or refund.

Please contact us if you believe purchased digital content is faulty or materially not as described.

Nothing in these Terms excludes or restricts these statutory rights.

29. How to Request a Direct Academy of Skills Refund

If your eligible purchase was made directly through Academy of Skills, contact:

Please provide sufficient information to identify your order, including where available:

  • your name;
  • the email address associated with your account;
  • the relevant course or subscription; and
  • your order or transaction reference.

You do not need to use any particular wording to clearly tell us that you wish to cancel where you have a cancellation right.

Approved refunds will normally be returned through the original payment method using our payment processor.

The time taken for funds to appear in your account after we issue a refund may depend on Stripe, your bank, card issuer or other payment provider.

Where applicable law requires us to provide a statutory model cancellation form, we will make it available as required.

30. Refunds for Third-Party Marketplace Purchases

Our direct Academy of Skills refund process applies primarily to eligible purchases made directly through academyofskills.org.

If you purchased an Academy of Skills course through a third-party website, marketplace, partner, reseller or other platform, you should normally submit your refund or cancellation request directly to the platform through which the purchase was made.

The third party may operate its own:

  • refund eligibility rules;
  • cancellation procedure;
  • refund period;
  • payment process; and
  • refund processing times.

Your purchase may therefore be subject to the third party's Terms and Conditions and Refund/Cancellation Policy.

Academy of Skills does not control the refund procedures of independent third-party marketplaces.

Where a third-party platform collected your payment, we may not be able to issue the refund ourselves.

Please contact that platform's customer-support service and follow the procedure applicable to your purchase.

If the platform reasonably requires information from Academy of Skills to investigate your request, you may contact us at info@academyofskills.org, and we will provide reasonable assistance where appropriate.

Nothing in this section excludes or restricts statutory consumer rights that cannot lawfully be excluded.

31. Subscription Cancellation and Refunds

Cancelling an automatically renewing subscription stops future renewals in accordance with the applicable cancellation arrangements.

Unless otherwise stated or required by law, cancelling an active subscription does not automatically entitle you to a refund for a subscription period already paid for.

You may normally continue using the subscription until the end of the paid billing period.

Fixed-term non-renewing subscriptions end according to their stated term.

Applicable statutory cancellation rights, our eligible 14-day refund arrangements and any other mandatory consumer protections continue to apply.

Where additional statutory subscription cooling-off, renewal, reminder or cancellation rights become applicable to your contract under UK law, we will comply with those requirements.

32. Acceptable Use

You may use Academy of Skills courses and learning materials for lawful personal learning purposes unless we expressly permit another use.

You must not:

  • share your learner account with another person;
  • sell or transfer course access;
  • allow another person to complete assessments using your identity;
  • copy or reproduce substantial parts of courses without permission;
  • redistribute or sell course materials;
  • commercially exploit our protected content without permission;
  • record or republish protected course content without permission;
  • scrape or systematically extract course materials without permission;
  • attempt to bypass security or access restrictions;
  • introduce malware or malicious code;
  • interfere with our website or learner platform;
  • fraudulently obtain certificates or results;
  • infringe our intellectual property rights or those of another person; or
  • use our services for unlawful purposes.

33. Intellectual Property

Course videos, text, graphics, documents, assessments, learning materials, branding, website content, course structures and other content made available through Academy of Skills may be protected by copyright, trade mark and other intellectual property laws.

Unless otherwise stated, Academy of Skills or its licensors owns or has the right to use the relevant intellectual property.

Purchasing a course or subscription does not transfer ownership of intellectual property to you.

You receive a limited, personal, non-exclusive and non-transferable right to access and use the purchased course materials for your own learning during the applicable access period.

You may not reproduce, distribute, sell, license or commercially exploit protected course materials without permission except where applicable law expressly permits it.

34. Suspension or Termination of Accounts

We may reasonably suspend or terminate access where a learner:

  • materially breaches these Terms;
  • shares, transfers or resells an account;
  • engages in fraudulent payment activity;
  • seriously misuses assessments or certificates;
  • unlawfully distributes course content;
  • attempts to compromise our website or security;
  • uses our services for unlawful purposes; or
  • commits another serious misuse of our services.

Where appropriate, we will provide reasonable notice and an opportunity to resolve the issue before termination.

We may take immediate action where reasonably necessary to protect learners, our systems, intellectual property, payment security or the integrity of our services.

We will exercise these rights reasonably and nothing in this section removes applicable statutory consumer rights.

35. Changes to Courses and Services

We may make reasonable changes to our website, learner platform, courses or services to:

  • improve functionality or quality;
  • correct errors;
  • update course information;
  • maintain security;
  • comply with legal or regulatory requirements;
  • respond to technological developments; or
  • respond to circumstances outside our reasonable control.

We will not use this provision to make arbitrary material changes that unfairly deprive you of the essential benefit of something you have already purchased.

Where a change materially affects your contractual rights, we will provide appropriate information or notice where required.

36. Third-Party Websites and Services

Our website or courses may contain links to independent third-party websites or services.

We do not control independent third-party websites and are not responsible for their content, privacy practices or availability merely because we provide a link to them.

A link does not necessarily constitute an endorsement.

Where you use an independent third-party service, that third party's own terms and privacy policy may apply.

Nothing in this section excludes responsibility that Academy of Skills cannot lawfully exclude.

37. Your Equipment and Internet Connection

Academy of Skills courses are provided online.

You are responsible for having a suitable device, compatible software/browser and internet connection necessary to access the courses.

Your internet, mobile-data, device and other third-party costs are your responsibility.

Where material technical requirements apply to a particular digital product, we will provide relevant information where reasonably required.

38. Our Responsibility to You

We are responsible for losses you suffer that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill, subject to applicable law.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed.

Where you purchase our services as a consumer, nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing in these Terms excludes or limits liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation; or
  • any other liability that cannot legally be excluded or limited.

Nothing in these Terms excludes or restricts mandatory rights available to consumers under applicable law.

39. Events Outside Our Reasonable Control

We are not responsible for failure or delay caused by circumstances outside our reasonable control.

  • how payment information is handled;
  • information we may receive from third-party marketplaces;

We want to resolve problems fairly and within a reasonable period.

Nothing in our complaints procedure prevents you from exercising statutory rights or remedies available to you.

42. Changes to These Terms

We may update these Terms from time to time to reflect:

  • changes in law or regulation;
  • changes to our services;
  • new products or subscription arrangements;
  • technology or security developments; or
  • reasonable changes to our business operations.

Changes will not retrospectively remove rights that you have already acquired under an existing contract where doing so would be unlawful or unfair.

Where a material change affects an ongoing subscription or service, we will provide reasonable notice where required.

43. Transfer of Our Rights

You may not transfer your learner account or personal course access to another person without our agreement.

44. Severability

The remaining provisions will continue to apply.

45. No Waiver

If we do not immediately enforce a right under these Terms, this does not mean that we have waived that right.

46. Third-Party Rights

Unless expressly stated otherwise, these Terms are between you and Academy of Skills.

No other person has a right to enforce these Terms except where applicable law provides otherwise.

47. Entire Agreement

These Terms, together with the product information presented to you before purchase and any policies expressly incorporated into the contract, form the agreement concerning the relevant purchase.

Nothing in this provision excludes liability for fraud or prevents a consumer from relying on information or representations that form part of the contract under applicable consumer law.

48. Governing Law and Courts

These Terms and contracts between Academy of Skills and consumers are governed by applicable UK law, subject to mandatory consumer protections that apply to you.

If you live in England or Wales, proceedings may be brought in the courts of England and Wales.

If you live in Scotland, you may generally bring proceedings in the Scottish courts or, where legally applicable, the courts of England and Wales.

If you live in Northern Ireland, you may generally bring proceedings in the Northern Irish courts or, where legally applicable, the courts of England and Wales.

Consumers living elsewhere may also have mandatory rights under the laws applicable where they live.
